1 – Begripsomschrijvingen

In deze algemene voorwaarden wordt verstaan onder:

• Aanbod: alle voorstellen, prijsindicaties en aanbiedingen die door Capítulo 8 worden gedaan via de website, sociale media of e-mail.

• Capítulo 8: de onderneming met maatschappelijke zetel te Florahof 21, 8370 Blankenberge, België, ondernemingsnummer 0806413656.

• Consument: de natuurlijke persoon die niet handelt in de uitoefening van een beroep of bedrijf en een aankoop doet via de website van Capítulo 8.

• Digitale gift voucher: een elektronische cadeaubon die per e-mail wordt verzonden in de vorm van een kortingscode.

• Herroepingsrecht: het recht van de consument om binnen 14 dagen na ontvangst af te zien van een online aankoop, conform artikel VI.47 en volgende van het Wetboek Economisch Recht (WER).

• Ingangsdatum: de datum waarop de overeenkomst tot stand komt, namelijk op het moment dat de aankoop is afgerond en de betaling is voldaan.

• Klant: iedere natuurlijke persoon (consument) die bij Capítulo 8 een aankoop doet en door deze aankoop akkoord gaat met deze voorwaarden.

• Overeenkomst: de koopovereenkomst die tot stand komt tussen de klant en Capítulo 8 na voltooiing van de bestelling en betaling.

• Papieren gift voucher: een fysieke cadeaubon die per post wordt verzonden.

• Producten: kleding, schoenen, juwelen en accessoires die door Capítulo 8 worden aangeboden via de website.

• Schriftelijk: communicatie via e-mail of, waar vereist, per aangetekende brief.

• Verkoper: Capítulo 8, die de producten en gift vouchers aanbiedt aan de klant.

2 – Toepassing van de voorwaarden

Deze algemene voorwaarden regelen de verkoop en levering van onze producten aan u, als klant, en geven informatie over uw rechten en plichten. Door een bestelling te plaatsen, gaat u akkoord met deze voorwaarden. Capítulo 8 behoudt zich het recht voor om deze voorwaarden op elk moment aan te passen of aan te vullen. De meest recente versie van de voorwaarden is steeds van toepassing.

3 – Aanbod en aanvaarding

De afbeeldingen die op de website, sociale media of in andere communicatie van Capítulo 8 worden getoond, dienen uitsluitend ter illustratie van de producten en collecties. Een deel van de beelden kan geheel of gedeeltelijk zijn gecreëerd met behulp van kunstmatige intelligentie (AI). Deze beelden zijn bedoeld om een realistische indruk te geven van stijl, sfeer en pasvorm, maar kunnen afwijken van de werkelijke uitstraling, kleur, proporties of details van het product. De productbeschrijving op de website is steeds bepalend. Capítulo 8 besteedt grote zorg aan de nauwkeurigheid van de getoonde informatie en visuals, maar kan niet aansprakelijk worden gesteld voor minimale visuele afwijkingen of interpretaties die voortkomen uit het gebruik van AI-beelden. Door gebruik te maken van de website erkent de klant dat illustraties, inclusief AI-gegeneerde beelden, louter informatief zijn en geen bindende productvoorstelling vormen.

Alle aanbiedingen op de website zijn vermeld in euro en inclusief btw, maar exclusief eventuele verzendkosten. Capítulo 8 behoudt zich het recht voor om een bestelling te weigeren in uitzonderlijke situaties, zoals bij bijzonder grote bestellingen of wanneer er eerder problemen zijn geweest met een klant. De aanvaarding van het aanbod vindt plaats zodra het online bestelproces volledig is afgerond en de betaling is voldaan, of wanneer een bestelling per e-mail door Capítulo 8 is bevestigd. Capítulo 8 is niet gebonden aan een kennelijk foutief aanbod, bijvoorbeeld in het geval van een onrealistisch hoge korting of een duidelijk te lage prijs.

4 – Prijzen en betaling

De prijs van elk product wordt vermeld op de website en is inclusief btw. Eventuele bijkomende kosten, zoals verzendkosten, worden afzonderlijk weergegeven en zijn ten laste van de klant. Betaling gebeurt onmiddellijk via een van de betaalmethoden die door Capítulo 8 worden aangeboden, waaronder Bancontact, KBC/CBC Payment Button, Belfius Direct Net, krediet- en debetkaarten, Apple Pay en iDEAL.

Bij aankoop van digitale gift vouchers kan de klant tijdens het betaalproces de code ‘GEENVERZENDKOSTEN’ gebruiken om verzendkosten te vermijden. Het gebruik van deze code gebeurt volledig onder verantwoordelijkheid van de klant. Indien de klant verkiest om geen gebruik te maken van deze code en alsnog verzendkosten betaalt, kunnen deze achteraf niet worden teruggevorderd of gecompenseerd.

Na betaling ontvangt de klant een bevestigingsmail met de factuur. De bestelling is pas definitief nadat deze bevestiging is ontvangen. Indien de e-mail niet in de inbox verschijnt, wordt aangeraden ook de spamfolder te controleren. Wanneer een bestelling onverhoopt niet door Capítulo 8 wordt geaccepteerd, wordt het reeds betaalde bedrag teruggestort via hetzelfde betaalmiddel als waarmee de oorspronkelijke betaling is verricht.

5 – Herroepingsrecht

Dit herroepingsrecht geldt voor consumenten die online bestellen. De klant heeft het recht om de aankoop binnen 14 dagen na ontvangst van het product te annuleren. Capítulo 8 mag naar de reden van herroeping vragen, maar de klant is niet verplicht deze te geven. De termijn van 14 dagen gaat in op de dag na ontvangst van het product door de klant of door een door de klant aangewezen derde.

Om het herroepingsrecht uit te oefenen, dient de klant binnen deze termijn een duidelijke verklaring per e-mail te sturen naar info@capitulo-8.com. Enkel ongedragen en onbeschadigde producten, voorzien van de originele labels en het aankoopbewijs, komen in aanmerking voor retour. Juwelen kunnen om hygiënische redenen niet worden geretourneerd. Indien het product sporen van gebruik vertoont die leiden tot waardevermindering, kan Capítulo 8 hiervoor een schadevergoeding aanrekenen.

Het product moet binnen 14 dagen na herroeping worden teruggestuurd naar Capítulo 8, Florahof 21, 8370 Blankenberge, België, samen met (een kopie) van de originele bestelbevestiging. De datum van afgifte bij de post geldt als verzenddatum. De kosten voor de retourzending zijn steeds voor rekening van de klant. Artikelen kunnen niet fysiek worden teruggebracht. Na ontvangst van de herroeping en controle van het geretourneerde product wordt de aankoopsom binnen 14 dagen terugbetaald via hetzelfde betaalmiddel als waarmee de oorspronkelijke betaling is verricht. De oorspronkelijke verzendkosten van de bestelling worden niet terugbetaald.

6 – Levering en risico

De levering gebeurt op het door de klant opgegeven adres of, in het geval van digitale gift vouchers, op het opgegeven e-mailadres. Fouten in deze gegevens vallen onder de verantwoordelijkheid van de klant.

De klant heeft bij het plaatsen van de bestelling de keuze tussen verschillende verzendmaatschappijen, elk met hun eigen verzendtarieven. De gekozen verzendmethode moet overeenstemmen met het land van bestemming van het product. Capítulo 8 kan niet instaan voor verkeerdelijk gekozen verzendmethodes of foutief geselecteerde bestemmingslanden; deze verantwoordelijkheid ligt volledig bij de klant.

De verzendkosten worden berekend op basis van het gewicht van het pakket en het land van bestemming. Producten worden doorgaans binnen 2 tot 5 werkdagen verzonden, en de klant ontvangt na verzending een track & trace-link om de levering te kunnen volgen. Niet-opgehaalde pakketten bij een afhaalpunt geven geen recht op annulering of terugbetaling.

Capítulo 8 biedt gratis verzending aan voor bestellingen die voldoen aan de opgegeven minimumbedragen:

• vanaf €100 voor leveringen binnen België;

• vanaf €150 voor leveringen binnen Europa (exclusief België).

De klant kan hiervoor gebruikmaken van de kortingscodes BE100 (België) of EU150 (Europa). De code BE100 is uitsluitend geldig indien het opgegeven leveringsadres zich daadwerkelijk in België bevindt. Wanneer het opgegeven leveringsadres niet overeenstemt met de gebruikte kortingscode, behoudt Capítulo 8 zich het recht voor om de gratis verzending te weigeren en de toepasselijke verzendkosten alsnog aan te rekenen. Een dergelijke correctie geeft de klant geen recht op annulering van de aankoop of schadevergoeding.

Capítulo 8 is niet aansprakelijk voor schade die ontstaat door vertraging of fouten van de transporteur. De aansprakelijkheid van Capítulo 8 blijft in alle gevallen beperkt tot de waarde van de niet ontvangen artikelen. Wanneer de klant bij het plaatsen van de bestelling kiest voor ‘ophaling in Blankenberge’, dient het product binnen 14 dagen na aankoop te worden afgehaald. De klant neemt hiervoor per e-mail contact op met Capítulo 8 om een voorstel tot afhaling te doen. Capítulo 8 zal, in de mate van het mogelijke, trachten aan dit voorstel tegemoet te komen, zonder dat hieruit een afdwingbaar recht kan worden afgeleid. Indien het product niet binnen 14 dagen wordt opgehaald, wordt de aankoop automatisch geannuleerd.

7 – Aansprakelijkheid

Capítulo 8 streeft naar een correcte uitvoering van elke overeenkomst en verbindt zich tot een inspanningsverplichting, geen resultaatsverplichting. Indien nodig kan Capítulo 8 voor de uitvoering van haar diensten of leveringen beroep doen op derden. In geval van een gebrekkig product zal Capítulo 8 trachten het gebrek te herstellen. Indien herstel niet mogelijk blijkt, kan de klant kiezen tussen vervanging of terugbetaling binnen 14 dagen na de melding van het gebrek.

Capítulo 8 kan niet aansprakelijk worden gesteld in situaties van overmacht. In geval van tijdelijke overmacht zal Capítulo 8 de uitvoering van de overeenkomst hervatten zodra dit redelijkerwijs mogelijk is. Er is evenmin aansprakelijkheid voor schade veroorzaakt door derden of voor verlies van zendingen tijdens transport; in dergelijke gevallen worden waar mogelijk vervangende producten aangeboden.

Capítulo 8 is niet aansprakelijk voor schade die het gevolg is van hacking, phishing of andere vormen van internetfraude, waarbij steeds redelijke beveiligingsmaatregelen worden toegepast om dergelijke risico’s te beperken.

8 – Gift vouchers

Gift vouchers zijn één jaar geldig vanaf de datum van uitgifte. Er zijn zowel papieren als digitale gift vouchers beschikbaar. De papieren versie wordt per post verzonden, terwijl de digitale gift voucher per e-mail wordt verstuurd naar het e-mailadres dat is opgegeven bij de bestelling. Wie een specifiek bedrag wil schenken, kan eenvoudig meerdere gift vouchers combineren tot het gewenste totaalbedrag. Gift vouchers worden uitgegeven als eenmalige kortingscode; het volledige bedrag wordt in één keer verrekend en een eventueel restant vervalt. Kies daarom de gift voucher die het beste past bij jouw cadeau — €25, €50 of €100.

9 – Gegevensverwerking

Door aankoop gaat de Klant akkoord met de verwerking van persoonsgegevens volgens onze privacyverklaring op de website. Persoonsgegevens worden verwerkt voor klantenbeheer, marketing en uitvoering van de overeenkomst.

10 – Algemeen

De rechten en verplichtingen die voortvloeien uit deze algemene voorwaarden kunnen niet worden overgedragen aan derden zonder voorafgaande schriftelijke toestemming van Capítulo 8. Indien een bepaling van deze voorwaarden geheel of gedeeltelijk nietig of ongeldig wordt verklaard, blijven de overige bepalingen volledig van kracht, en zal de nietige bepaling worden vervangen door een bepaling die zoveel mogelijk aansluit bij het doel en de strekking van de oorspronkelijke bepaling. Op deze overeenkomst is uitsluitend het Belgisch recht van toepassing. Eventuele geschillen vallen onder de exclusieve bevoegdheid van de rechtbanken van Brugge, tenzij dwingende wetsbepalingen anders voorschrijven.

In these general terms and conditions, the following definitions apply:

• Offer: all proposals, price indications and offers made by Capítulo 8 via the website, social media or email.
• Capítulo 8: the company with its registered office at Florahof 21, 8370 Blankenberge, Belgium, company number 0806413656.
• Consumer: any natural person who acts for purposes outside their trade, business, craft, or profession and makes a purchase through the Capítulo 8 website.
• Digital gift voucher: an electronic gift card sent by email in the form of a discount code.
• Right of withdrawal: the consumer’s right to withdraw from an online purchase within 14 days after receipt, in accordance with Articles VI.47 et seq. of the Belgian Code of Economic Law (WER).
• Effective date: the date on which the agreement is concluded, namely when the purchase has been completed and payment has been made.
• Customer: any natural person (consumer) who makes a purchase from Capítulo 8 and, by doing so, agrees to these terms and conditions.
• Agreement: the purchase contract concluded between the customer and Capítulo 8 after completion of the order and payment.
• Paper gift voucher: a physical gift card sent by post.
• Products: clothing, shoes, jewellery, and accessories offered by Capítulo 8 via the website.
• Written communication: communication via email or, where required, by registered letter.
• Seller: Capítulo 8, offering products and gift vouchers to the customer.

2 – Application of the terms

These general terms and conditions govern the sale and delivery of our products to you as a customer and provide information on your rights and obligations. By placing an order, you agree to these terms. Capítulo 8 reserves the right to amend or supplement these terms at any time. The most recent version of the terms and conditions always applies.

3 – Offer and acceptance

Images shown on the website, social media, or other Capítulo 8 communications are intended solely to illustrate products and collections. Some images may be created entirely or partially using artificial intelligence (AI). These visuals are meant to provide a realistic impression of style, atmosphere, and fit but may differ from the actual appearance, colour, proportions, or details of the product. The product description on the website is always decisive. Capítulo 8 takes great care to ensure the accuracy of the information and visuals provided but cannot be held liable for minor visual differences or interpretations resulting from the use of AI-generated images. By using the website, the customer acknowledges that all images, including AI-generated ones, are for illustrative purposes only and do not constitute a binding representation of the product.

All offers on the website are listed in euros, including VAT, but excluding possible shipping costs. Capítulo 8 reserves the right to refuse an order in exceptional cases, such as unusually large quantities or previous issues with a customer. Acceptance of the offer occurs once the online order process is fully completed and payment has been made, or when an order has been confirmed by Capítulo 8 via email. Capítulo 8 is not bound by any manifest error in an offer, for example, an unrealistically high discount or clearly incorrect price.

4 – Prices and payment

The price of each product is displayed on the website and includes VAT. Any additional costs, such as shipping fees, are shown separately and are the responsibility of the customer. Payment must be made immediately through one of the payment methods offered by Capítulo 8, including Bancontact, KBC/CBC Payment Button, Belfius Direct Net, credit and debit cards, Apple Pay, and iDEAL.

When purchasing digital gift vouchers, customers may use the code ‘FREESHIPPING’ during checkout to avoid shipping charges. The use of this code is entirely at the customer’s discretion. If the customer chooses not to use this code and still pays for shipping, these costs cannot later be refunded or compensated.

After payment, the customer receives a confirmation email with the invoice. The order is only final once this confirmation has been received. If the email does not appear in the inbox, the customer is advised to check the spam folder. If, for any reason, Capítulo 8 does not accept an order, the amount already paid will be refunded using the same payment method used for the original transaction.

5 – Right of withdrawal

This right applies to consumers ordering online. The customer has the right to cancel the purchase within 14 days after receiving the product. Capítulo 8 may ask for the reason for withdrawal, but the customer is not obliged to provide one. The 14-day period begins on the day after receipt of the product by the customer or by a third party designated by the customer.

To exercise the right of withdrawal, the customer must send a clear statement by email to info@capitulo-8.comwithin this period. Only unworn and undamaged items, complete with original tags and proof of purchase, are eligible for return.
For hygiene reasons, jewellery cannot be returned.
If a returned product shows signs of use resulting in depreciation, Capítulo 8 may charge compensation.

The product must be returned within 14 days of withdrawal to: Capítulo 8, Florahof 21, 8370 Blankenberge, Belgium,
together with (a copy of) the original order confirmation. The date of postal dispatch counts as the return date. Return shipping costs are always borne by the customer. Items cannot be returned in person. After receiving and inspecting the returned item, the purchase amount will be refunded within 14 days via the original payment method. The original shipping costs are non-refundable.

6 – Delivery and risk

Delivery is made to the address provided by the customer or, in the case of digital gift vouchers, to the provided email address. Errors in these details are the customer’s responsibility.

Customers can choose from several shipping carriers, each with its own rates. The selected shipping method must correspond to the destination country.
Capítulo 8 is not responsible for incorrectly chosen shipping methods or destination countries; this remains the sole responsibility of the customer.

Shipping costs are calculated based on the package weight and destination. Products are generally dispatched within 2–5 working days, and the customer receives a track & trace link once shipped.
Parcels not collected from a pick-up point are not eligible for cancellation or refund.

Capítulo 8 offers free shipping for orders that meet the specified minimum amounts:

• From €100 for deliveries within Belgium
• From €150 for deliveries within Europe (excluding Belgium)

Customers may use the codes BE100 (Belgium) or EU150 (Europe). The BE100 code is valid only if the delivery address is located in Belgium. If the delivery address does not correspond to the discount code used, Capítulo 8 reserves the right to revoke the free shipping and charge the applicable shipping cost. Such a correction does not entitle the customer to cancel the purchase or claim compensation.

Capítulo 8 is not liable for delays or errors by the carrier. In all cases, Capítulo 8’s liability is limited to the value of the undelivered items. When choosing “collection at Blankenberge,” the product must be collected within 14 days of purchase. The customer must contact Capítulo 8 via email to propose a collection time. Capítulo 8 will accommodate this request as far as reasonably possible, but no enforceable right arises from such proposals.
If the product is not collected within 14 days, the purchase is automatically cancelled.

7 – Liability

Capítulo 8 strives for the correct execution of every agreement and commits to a best-effort obligation, not a result obligation.
If necessary, Capítulo 8 may engage third parties for the execution of its services or deliveries. In the case of a defective product, Capítulo 8 will attempt to repair the defect. If repair is not possible, the customer may choose between replacement or refund within 14 days after reporting the defect.

Capítulo 8 cannot be held liable in cases of force majeure. In the event of temporary force majeure, performance of the agreement will resume as soon as reasonably possible. Nor is Capítulo 8 liable for damage caused by third parties or loss of shipments during transport; replacement products will be offered where possible.Capítulo 8 is not liable for damages resulting from hacking, phishing, or other forms of internet fraud, although reasonable security measures are always applied to limit such risks.

8 – Gift vouchers

Gift vouchers are valid for one year from the date of issue. Both paper and digital versions are available. Paper vouchers are sent by post; digital vouchers are sent by email to the address provided during the order process. Customers wishing to gift a specific amount may combine multiple vouchers to reach the desired total. Gift vouchers are issued as one-time discount codes; the full amount must be used in a single purchase, and any remaining balance will expire. Choose the voucher that best fits your gift — €25, €50, or €100.

9 – Data processing

By making a purchase, the customer agrees to the processing of personal data in accordance with our privacy policy published on the website. Personal data is processed for customer management, marketing, and the execution of the agreement.

10 – General provisions

The rights and obligations arising from these terms and conditions may not be transferred to third parties without prior written consent from Capítulo 8. If any provision of these terms is wholly or partially void or invalid, the remaining provisions shall remain in full force, and the invalid clause shall be replaced by a provision that best reflects the original intent.
This agreement is governed exclusively by Belgian law. Any disputes fall under the exclusive jurisdiction of the courts of Bruges, unless mandatory legal provisions provide otherwise.
